自证其罪

自证其罪是指自己在遇到法律訴訟時承認自己有罪的行为[1]。自证其罪可分為直接自证其罪或间接自证其罪，一個人如果是在审讯時承認自己有罪，則屬於直接自证其罪；而在没有他人压力的情况下自愿坦白自己犯罪行為的則屬於間接自证其罪[2]。

许多國家的法律規定，不能强迫被指控的嫌疑犯自证其罪，嫌疑犯可以选择在審訊時自願向警察坦白，但警察不能因嫌犯拒绝坦白而惩罚嫌疑犯。嫌疑犯有保持沉默的权利和获得辯護律師的权利[3]。
